Dear SVA Board Members,
I am a dues paying SVA Member and candidate for Election -- and you are elected public officials. It is unlawful of you to block me from the SVA Page on Facebook.
Please unblock me -- and all other BLOCKED SVA MEMBERS -- immediately!
Did you consult the Association Board Attorney, Personal Injury/car accident lawyer Frank Phillips, about this unlawful practice? Or Andres Rabinovich of PMI Properties?
Excuse me? Are you saying neither of them advised you that you are breaking the law?
A lawyer who focuses their practice on Condominium Law would help you protect our Property and act lawfully to members. Condo attorneys Ron Sher or Justin Buchel or Lisa A. Smith would advise you of many important things, including these facts:
In New York State, if a public official uses their account to carry out their role as an elected official, then their Page or account is subject to the First Amendment. That means they cannot engage in most forms of censorship such as blocking someone or deleting someone's comments just because of their subject or opinion.
Also, please note that the board is required by law but has failed to comply. As a candidate, I am owed the NAMES, addresses, and all contact info you have on the 78 SVA Members of Phase 3 who are able to vote in the Election on Wednesday.
I have requested that info but it has still not arrived. Please send that via email today
SVA unit owners deserve a free and fair election!
Thank you very much,
Linda Watson
